a.      Definition of Relative for Parent Elections
                                                  i.     HB 277 amended KRS 160.180 to change the definition of relative, when talking about members of local boards of education.  This new bill does not affect school councils.  Since the school council law (KRS 160.345) does not define “relative” councils follow the Attorney General’s opinion that says to use KRS 160.380(1)(c) for purposes of the SBDM law.  That is, the definition remains the same: parent members on the council cannot be the mother, father, brother, sister, son, daughter, husband, wife, aunt, uncle, son-in-law, or daughter-in-law of someone who works at OKH.
b.     Changes in Principal Selection Process
                                                  i.     According to SB1 (2017): Before the regular selection process begins, the superintendent may propose a candidate to the council.  The council shall keep the name confidential.  The council may accept or decline this candidate.  If the council decides to select the proposed candidate, the superintendent will complete the hiring process and follow the usual procedures for announcing a new principal.  If they decline, the council follows the typical principal selection process.
c.      Adding a Non-Voting Member to the Council
                                                  i.     SBDM councils wishing to include non-voting classified or student members must submit an alternative model application to the Kentucky Department of Education. The model should include, but not be limited to, a description of the membership, organization, duties and responsibilities of the school council. The school must submit the model through the local board of education to the commission of education and the Kentucky Board of Education, which shall have the final authority for approval. Additionally the application for approval of the model must show evidence that it has been developed by representatives of the parents, students, certified personnel and the administrators of the school and that two-thirds of the faculty have agreed to the model KRS 160.345(7).
